YOUR QUESTIONS, ANSWERED
Eligible entities outside the Health Care Clinic Act’s definition of a clinic may voluntarily apply to AHCA for a certificate documenting exempt status. It is not a clinic license and does not replace other applicable licensing or payer requirements.
No. The applicable statutory category and its ownership, supervision, and service conditions must be satisfied. A practitioner’s involvement alone does not establish an exemption. Obtain a healthcare attorney’s advice when the legal basis is uncertain.
Yes. AHCA requires certificates to be renewed every two years. Check the certificate’s expiration date and current renewal instructions rather than relying only on a reminder. SDC can help organize renewal preparation.
A certificate does not transfer to a buyer. AHCA requires a new initial certificate application for a transfer of ownership and an advance application for an address change. Discuss the proposed transaction and dates before making the change.
Do not assume that accepting cash proves an exemption. Describe the services and billing model for review. Personal injury protection (PIP) reimbursement has separate licensing and exemption conditions; ask a healthcare attorney to assess the applicable requirements.
SDC supports document organization, application preparation, follow-up, and renewal or change planning within the agreed administrative scope. SDC does not provide legal opinions, design ownership structures, or guarantee approval. An attorney should resolve uncertain eligibility, transactions, or enforcement questions; AHCA reviews certificate applications.
